Le délit d'initié: vers une répression accrue

The National Council agreed in March 2008, without oppositions or abstentions, that the existing regulation regarding insider trading, Article 161 of the Swiss Penal Code (“CP”), should be amended. The Council of State also endorsed this change last year. The amendment consists of the removal of chapter 3 of Article 161 CP. The aim and effect of this removal is to punish insider trading more severely. It is also consistent with the ongoing process of harmonization of Swiss legislation with European rules and FATF recommendations.
